350. Where the person summoned pleads not guilty, the board or the racing judges shall proceed with the hearing on the notice of prosecution, hear the witnesses and examine the exhibits and documents for the prosecutor and the defendant.
The deposition of a witness is taken under oath and in the presence of the person summoned or, if he is absent, in the presence of his counsel.
